End-of-Life Vehicles (ELV) Regulations
What the vehicle owner must do
The Waste Management (End-Of-Life Vehicles) Regulations, S.I. No. 282 of 2014, place an obligation on vehicle owners. Where the registered owner of an end-of-life vehicle intends to discard that vehicle as waste, he or she is required to deposit that vehicle at an authorised treatment facility for appropriate treatment and recovery. If the vehicle is not roadworthy, the services of a permitted waste collector must be used to transport the ELV to the facility.
An authorised treatment facility or ATF is a facility where the collection and storage and treatment of end-of-life vehicles may take place. Authorised treatment facilities must operate under a waste licence or waste facility permit, as appropriate, in accordance with Section 39 of the Waste Management Acts 1996, as amended, and associated regulations.
It is therefore an offence under waste management legislation to undertake the collection or storage or treatment of end-of-life vehicles without the appropriate authorisation
When seeking to dispose of an end-of-life vehicle, it is important that the registered owner of the vehicle ensures that they receive a Certificate of Destruction for the vehicle from the ATF. This is a statutory document, and cannot be copied or amended by any person.
